Terms of Use.

1. Agreement to Terms

By registering an account and using AlwaysUp.dev ("the Platform", "the Service"), you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you are prohibited from using our services.

2. Services and Account Registration

AlwaysUp.dev provides website, API, and network port monitoring services. To use the Platform, you must register a valid user account. You are responsible for safeguarding your account login credentials, including passwords and API keys. We cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.

3. Plan Limits and Usage Rules

Your use of the Platform is subject to the limitations of your active subscription plan:

  • Free Plan: Limited to 2 monitors and a minimum check interval of 300 seconds (5 minutes). Only email alerts are supported.
  • Solo & Team Plans: Increased monitor capacity and check frequency (down to 60 seconds) with SMS, Slack, Telegram, Discord, and Webhook alert integrations.
  • Enforcement: You must not attempt to bypass these limits programmatically or otherwise. Doing so may result in permanent suspension of your account.

4. Acceptable Use Guidelines

You agree that you will not:

  • Configure monitoring targets that do not belong to you or for which you do not have explicit authorization to monitor.
  • Use the Platform's checkers to perform Denial of Service (DoS) attacks or load tests on target servers.
  • Attempt to disrupt or compromise the integrity, security, or performance of the Platform's core systems.

5. Payment and Subscription Fees

Some parts of the Services are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis (monthly or annually).

At the end of each billing cycle, your subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it. Cancelled paid accounts are downgraded to the Free plan tier at the end of the paid term.

6. Limitation of Liability

In no event shall AlwaysUp.dev, its developers, or its suppliers be liable for any damages (including, without limitation, damages for loss of data, loss of revenue, or business interruption) arising out of the use or inability to use the Platform, even if notified of the possibility of such damage.

While we strive to maintain high check accuracy and fast notification delivery, we do not guarantee 100% uptime of the Service or zero notification delays.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
